'Bengali actress Nusrat Jahan and Nikhil Jain's wedding not legally valid,' declares Kolkata court

On Wednesday, a Kolkata court observed that Bengali actress and Trinamool Congress MP Nusrat Jahan's wedding with businessman Nikhil Jain is "not legally valid". Nikhil had reportedly approached the court for a declaration that no marriage took place between him and Nusrat. The ex-couple tied the knot in 2019 in Turkey.

A news portal quoted Civil Judge S Roy of 2nd court, Alipore, and the order. “It is declared that the alleged marriage held on 19/06/2019 at Bodrum, Turkey in between the plaintiff and the defendant is not legally valid," the statement mentioned in the report read. Reportedly, the Kolkata court noted in the order that Nikhil and Nusrat celebrated a wedding party with their close friends and relatives “following both Western and Indian style and rituals of Hindu marriage." The court observed that the marriage was never registered in Turkey.

In June this year, Nusrat opened up about her 'separation' from Nikhil. She told in a statement that they have been living separately since November 2020, but there is no case of divorce as they got married in Turkey under Turkish laws and hence their union is not recognized by Indian marital laws. In a 7-point statement, Nusrat stated, "Being on foreign land, as per Turkish Marriage Regulation, the ceremony is invalid. Moreover, since it was an interfaith marriage, it requires validation under Special Marriage Act in India, which did not happen. As per the court of law, it is not a Marriage, but a relationship or a live-in relationship. Thus, the question of divorce does not arise. Our separation happened long back, but I did not speak about it as I intended to keep my private life to myself. Thus, my actions must not be questioned based on “separation”, by the media or anybody I am not related to. The alleged marriage is not legal, valid and tenable; and thus, was not a marriage at all in the eye of law." 

On the other hand, Nikhil had told that he tried to convince Nusrat to get their marriage registered. However, she refused to do it. In a statement, he had shared, "I was deeply in love with Nusrat. And I wanted to be with her all my life. But things turned sour. She never wanted to make this marriage legal. I am happy I won the case. Mentally I have moved on, but now I am legally free too." 

Nusrat and Nikhil's Turkey wedding was grand and lavish. The ex-couple hosted a reception for friends and family members in Kolkata. West Bengal CM Mamata Banerjee had attended the event. Nusrat has reportedly tied the knot with Bengali actor Yash Dasgupta. She is parenting her son Yishaan, born in August this year, with him.
